Advising French companies in Germany

Legal framework parameters
Setting up a foreign subsidiary has been greatly simplified in both Ger-many and France over the last few years:

Both countries now offer simple legal forms with little capital tied up that can be quickly entered in the pertinent register. Not even notarised au-thentication is needed nowadays.

But it is ever more complicated to set up a factory or plant in the perti-nent neighbouring country. In particular, European law requirements of-ten make the procurement of a building permit, an emission control ap-proval or a plant operation permit a protracted process, one in which you as the investor have to deal with numerous public authorities, but also neighbours and environmental protection bodies. Environmental impact assessments or preassessments have to be carried out, nature and species protection expertises obtained, compensation areas for interference with nature and landscape defined and nature and environmental stipulations in the approval heeded. Due to the cramped space in Germany, even areas outside conurbations are seeing conflicts between different types of use, such as residential use, industrial and trade use, transport routes, energy systems, flora-fauna habitats and other protected areas.
